Terms of Service and Data Protection Policy — SECTRON NEXUS Application

These terms describe the rules for using the SECTRON NEXUS application and the way in which SECTRON s.r.o. processes the personal data of application users. This document is intended for display within the application under "Terms of Service and Data Protection Policy".

1. Who Provides the Service

The operator of the SECTRON NEXUS application is SECTRON s.r.o., Company ID (IČO): 64617939, VAT ID (DIČ): CZ64617939, registered office at Josefa Šavla 1271/12, Mariánské Hory, 709 00 Ostrava, Czech Republic, registered in the Commercial Register maintained by the Regional Court in Ostrava, Section C, Insert 14152.

In these terms, we use the designations "SECTRON", "we" or "operator". The application user is referred to as "user" or "you".

2. What is SECTRON NEXUS

SECTRON NEXUS is a mobile digital application designed for the management, control and monitoring of the SECTRON NEXUS portable EV charger (hereinafter "charger" or "device"). The application enables remote configuration, charging status monitoring and device settings management via wireless Bluetooth or Wi-Fi (2.4 GHz) connection.

The specific features available in the application may vary depending on the charger model, device firmware version, application version and user account settings.

SECTRON NEXUS may enable in particular:

  • pairing and managing the charger via Bluetooth or Wi-Fi,
  • monitoring the current charging status, power input, voltage, current, temperature and energy consumption,
  • setting the charging current in the range of 6 A to 32 A (or up to 40 A depending on the model) in 1 A steps,
  • setting up and managing scheduled (reservation) charging, including time windows and days of the week,
  • managing the charging mode, including the Plug & Charge function,
  • managing RFID cards for charging authorisation (adding, activating, deactivating — up to 6 cards),
  • configuring the device's Wi-Fi connection and OCPP parameters for connection to backend systems,
  • viewing charging history (up to 30 records),
  • setting a PIN code to protect access to the device,
  • setting the date, time, language, display brightness and other device parameters,
  • viewing device information, serial number and software version,
  • viewing and managing Load Balancing settings and ModBus TCP communication,
  • viewing operational alerts, fault codes and recommended troubleshooting procedures.

If a particular feature is available only for a specific device model, firmware version or account type, this does not create an obligation on SECTRON to make it available to all users.

3. Supported Devices and Compatibility

The SECTRON NEXUS application is designed for controlling SECTRON NEXUS portable EV chargers equipped with a Bluetooth and/or Wi-Fi (2.4 GHz) module.

The application is available for mobile devices running Android (Google Play) and iOS (App Store). For the application to function correctly, it is necessary to:

  • enable Bluetooth and/or Wi-Fi on the mobile device,
  • grant the application location permission as required by the operating system for Bluetooth device discovery,
  • use an up-to-date version of the application and the mobile device's operating system.

SECTRON does not guarantee full functionality of the application on devices that do not meet the minimum technical requirements or on devices with a modified operating system (root, jailbreak).

4. Relationship to Other Agreements and Documentation

These terms govern the use of the SECTRON NEXUS application. The operation, installation, safety and technical parameters of the charger itself are governed by the applicable device user manual, technical documentation and any separate contract or order concluded with SECTRON.

In the event of a conflict, the individual contract, order or special conditions of the specific service shall take precedence. These terms do not replace the charger user manual, safety instructions or device technical documentation.

The SECTRON NEXUS application serves as a supplementary tool for controlling and configuring the device. The safety instructions and procedures set out in the charger user manual are binding and take precedence over any settings made through the application.

5. User Account

Some features of SECTRON NEXUS are available only after creating and logging in to a user account. An account may be created by registering in the application, by invitation from SECTRON, or by another procedure permitted by the application.

When creating and using an account, you are required to provide accurate, complete and up-to-date information. If you are acting on behalf of a legal entity, sole trader or other customer, you confirm that you are authorised to do so.

Protect your access credentials from misuse. If you discover or suspect that an unauthorised person has gained access to your account, notify us without undue delay. You are responsible for activity carried out through your account to the extent caused by you or by a person to whom you have granted access.

SECTRON may temporarily restrict or block access to an account where necessary for security reasons, for data protection purposes, where account misuse is suspected, or where these terms have been breached.

6. Rules for Using the Application

Use the application only in the manner for which it is intended, i.e. for controlling and configuring the SECTRON NEXUS charger. You must not use it in particular to:

  • gain unauthorised access to accounts, systems, devices or data,
  • disrupt the operation of the application, network, servers or connected devices,
  • circumvent security features, limits or permissions,
  • carry out automated data scraping without our prior consent,
  • distribute malicious code, spam, fraudulent messages or unlawful content,
  • interfere with the application, its source code, interfaces or protective elements,
  • set charging parameters that exceed the technical limits of the device or the capacity of the electrical installation,
  • act in a manner that could harm SECTRON, other users, customers or third parties.

When configuring the charging current through the application, you are required to take into account the capacity of the electrical installation, circuit breakers and supply cable. Setting an inappropriate current may cause damage to the device or the electrical installation. You are responsible for correct configuration.

If you upload any materials to the application, you are responsible for ensuring that you have the right to use them and to provide them to SECTRON.

7. Safety Notices When Using the Application

The SECTRON NEXUS application enables remote control of the charging device. When using it, you must observe the safety rules set out in the charger user manual. In particular:

  • never disconnect the charger connectors while charging is in progress; always stop charging first using the vehicle controls or the application,
  • protect connectors and sockets from moisture and water; always cover disconnected connectors with protective caps,
  • do not attempt to modify or repair the charger yourself,
  • in the event of a charger fault or damage, immediately disconnect the device from the mains and contact customer support,
  • the application is not a substitute for a physical inspection of the charger and electrical installation.

The SECTRON NEXUS application is not an emergency, breakdown or safety service. In urgent situations, use the appropriate emergency or breakdown contacts and physically disconnect the charger from the mains.

8. OCPP and Load Balancing Features

The application enables configuration of the OCPP 1.6-J protocol for connecting the charger to charging management backend systems. OCPP settings (ChargeID, server URL) are configured exclusively through the application. Once OCPP is activated, the application can no longer connect to the charger.

The Load Balancing feature enables control of the charging current via ModBus TCP communication in Wi-Fi mode. Once Load Balancing or ModBus TCP is activated, the application can no longer connect to the charger.

We recommend that the configuration of these features be entrusted to a qualified professional. SECTRON is not liable for damage caused by incorrect OCPP or Load Balancing configuration.

9. Complaints, Defects in the Digital Service and Support

If the application is not functioning correctly or a problem with the charger connection occurs, contact us via the in-app support or at hotline@sectron.cz. In your report, please include a description of the issue, the charger model, your mobile device type, the application version, the operating system version, the time of occurrence and a screenshot if relevant.

A user who is a consumer is entitled, in the event of defects in the digital service, to the rights set out in the Civil Code. Depending on the nature of the defect, the user may request in particular a remedy, a proportionate price reduction or termination of the contract, where permitted by law.

We handle complaints and grievances without undue delay, and no later than within the time limits set by law. To assess a technical fault, we may require your cooperation, such as updating the application or charger firmware, verifying Bluetooth or Wi-Fi connectivity, or providing additional device information.

10. Availability, Maintenance and Changes to the Application

SECTRON strives to operate the SECTRON NEXUS application reliably and securely. However, the application may not be available continuously. Availability may be limited in particular during application or device firmware updates, Bluetooth/Wi-Fi or internet connectivity outages, security measures or events beyond our control.

The application may be updated on an ongoing basis. Updates may introduce new features, modifications to existing features, security patches or compatibility changes with new charger firmware versions. Some features may require an up-to-date version of the application, operating system or charger firmware.

Data displayed in the application — in particular operational, measured or consumption data — may be informational in nature. The authoritative data may be that recorded directly by the device or set out in other binding documentation.

11. Intellectual Property

The SECTRON NEXUS application, its appearance, source code, databases, texts, graphics, designations and other elements are protected by the intellectual property rights of SECTRON or its suppliers.

For the duration of your authorised access to the application, SECTRON grants you a non-exclusive, non-transferable and revocable permission to use the application for your own purposes and in accordance with these terms. This permission does not include the right to copy, modify, rent, sell, transfer, reverse engineer or make the application available to third parties beyond the normal use permitted by the application.

12. Liability

SECTRON is liable for damage and harm to the extent provided for by law. This does not affect consumer rights that cannot be contractually limited.

To the extent permitted by law, SECTRON is not liable for difficulties caused in particular by:

  • improper use of the application or charger,
  • an outdated version of the application, charger firmware or mobile device operating system,
  • Bluetooth, Wi-Fi, internet or mobile network outages,
  • incorrect configuration of the charging current, OCPP or Load Balancing by the user,
  • damage to the charger, electrical installation or vehicle resulting from inappropriate settings made through the application,
  • unauthorised interference with a device, account or access credentials,
  • a decision made by the user based solely on informational data displayed in the application.

The user acknowledges that the application cannot fully replace a physical inspection of the charger, a professional service call, a binding measurement or safety procedures required by law or the device technical documentation.

13. Termination of Use

You may stop using the application at any time. If you wish to close your account, contact support or use the relevant feature in the application, if available.

Closing your account does not automatically affect the continuation of separate contracts, orders, invoices, service obligations or statutory duties. We may therefore retain certain data even after account closure, where this is necessary for the performance of a contract, a legal obligation or the protection of legal claims.

SECTRON may close or restrict an account if the user materially breaches these terms, misuses the application, endangers security, has not used the account for an extended period, or where the legal basis for access to the service ceases to exist.

14. Consumer Rights in Distance Contracts

If you are a consumer — that is, a natural person who, when using the application or placing an order, is not acting in the course of a business or independent professional activity — you are entitled to rights under consumer protection legislation.

In the case of a distance contract, you may generally withdraw within 14 days of conclusion of the contract or of receipt of the goods, unless an exception is provided for by law.

For a digital service or digital content provided before the expiry of the 14-day period, you may be asked for your express consent to the commencement of performance before it begins. If performance is commenced at your request, your right of withdrawal may be limited to the extent permitted by law.

You may send your withdrawal to obchod@sectron.cz or in writing to SECTRON's registered office address. A model withdrawal notice is set out at the end of these terms.

15. Changes to the Terms

We may amend these terms on a reasonable basis, in particular due to changes in legislation, changes to the application or charger, the introduction of new features, security requirements, or changes to technical and operational processes.

We will notify you of any material change in an appropriate manner, for example within the application or by email. If you do not agree with the change, you may stop using the application before the change takes effect. This does not affect your statutory rights or any claims that have already arisen.

16. Governing Law and Dispute Resolution

These terms are governed by the laws of the Czech Republic. If you are a consumer and the laws of your country of residence afford you greater protection, that protection is not affected.

We will endeavour to resolve any disputes preferably by amicable means. You may contact us at obchod@sectron.cz or in writing at SECTRON's registered office address.

A consumer has the right to submit a proposal for out-of-court resolution of a consumer dispute to the relevant ADR body. In ordinary consumer disputes not falling within the jurisdiction of a specialised authority, the competent body is the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, website: https://adr.coi.cz/cs.

The European Online Dispute Resolution (ODR) platform was discontinued in 2025 and is therefore not referenced in these terms.

In connection with the SECTRON NEXUS application, we may process the following categories of data:

We do not deliberately require special categories of personal data in the SECTRON NEXUS application.

19. Why We Process Data and on What Legal Basis

Performance of a contract and provision of the application

We process data in order to create and manage your account, provide access to application features, enable charger pairing and control, display operational and charging data, handle requests and provide support.

The legal basis is the performance of a contract or the taking of steps prior to entering into a contract.

Compliance with legal obligations

We must process certain data to comply with statutory obligations, in particular in the areas of accounting, taxation, consumer complaints or cybersecurity.

The legal basis is compliance with a legal obligation.

Legitimate interests of SECTRON

We may also process data on the basis of our legitimate interests, in particular:

  • protecting the application, accounts and devices from misuse,
  • preventing fraud, unauthorised access and security incidents,
  • evidencing legal acts and asserting and defending legal claims,
  • improving the application, firmware, services and customer support,
  • sending commercial communications relating to our own similar products and services, where permitted by law and where you have not opted out.

You may object to processing based on legitimate interests.

Consent

In some cases, we process data on the basis of your consent, in particular:

  • access to device location for Bluetooth device discovery, where you grant permission,
  • optional analytical or marketing technologies,
  • marketing push notifications.

You may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

20. Data Retention Periods

We retain personal data only for as long as necessary for the given purpose:

Upon expiry of the applicable period, we will delete, anonymise or restrict the processing of data.

21. Recipients of Data

Personal data may be disclosed only to the extent necessary for the purposes stated above, in particular to:

  • providers of IT infrastructure, hosting, cloud services and security tools,
  • developers, administrators and service partners of the SECTRON NEXUS application,
  • providers of customer support and communication services,
  • providers of analytical and diagnostic tools,
  • accounting, tax, legal and audit advisors,
  • service and technical partners, where necessary for handling a complaint or service request,
  • public authorities, where required by law.

We enter into data processing agreements with processors. We do not sell personal data.

22. Transfers Outside the European Economic Area

We process personal data preferentially within the European Union or the European Economic Area. If a transfer outside this area is to take place, we will ensure an appropriate legal mechanism is in place in accordance with the GDPR.

23. Bluetooth, Wi-Fi and Application Permissions

The SECTRON NEXUS application uses Bluetooth (for pairing and configuration) and Wi-Fi (for remote control and OCPP) to communicate with the charger. The following permissions may be required for the application to function correctly:

You grant permissions through your mobile device settings and may revoke them at any time, although this may limit the functionality of the application.

24. Push Notifications and Communications

The application may send service, operational or marketing notifications, such as alerts for charging completion, charger fault states or firmware updates.

Service and operational notifications form part of the provision of the application. We will send you marketing notifications only where we have a legal basis to do so. You may opt out of marketing communications at any time via the application settings or the contact details set out in this policy. You may also control push notification settings in your device's operating system.

25. Automated Decision-Making

The SECTRON NEXUS application does not carry out decision-making based solely on automated processing that would produce legal effects for you or similarly significantly affect you.

In connection with the processing of personal data, you have in particular the following rights:

27. Data Security

We use technical and organisational measures appropriate to the nature of the data and the risks of processing to protect personal data, including in particular access controls, secure communications, logging, backups and contractual obligations imposed on persons who handle the data. We also recommend that you protect your mobile device, email account and application access credentials.

28. Children

The SECTRON NEXUS application is not intended for children under the age of 15. If you are under 15, please use the application only with the consent and supervision of a legal guardian.

29. Changes to the Data Protection Policy

We may update this policy, in particular if the application, charger, purposes of processing, applicable law or technologies used change. The current version will be available within the application. We will notify you of any material changes in an appropriate manner.
